Terms and Conditions

TERMS & CONDITIONS

These Terms & Conditions (the "Agreement") constitute a legal agreement between you (the "User" or "Client") and Goldie Creative Limited ("we," "us," or "Goldie Creative"). By accessing and using our services, you agree to the following terms:

1. ACCEPTANCE OF TERMS

By replying to a quote via email, you confirm your acceptance of Goldie Creative’s Terms & Conditions. No work will commence until this acceptance has been received.

2. CONFIDENTIALITY

Any information deemed confidential by either party must be clearly designated as such.

3. PAYMENT TERMS

• A 50% deposit of the total fee is required before work begins. Goldie Creative reserves the right to withhold work until payment is received.

• Final payment is due before any digital files are delivered or artwork is printed.

• Payment must be made via direct deposit to the following ASB bank account: Goldie Creative Limited, 12-3046-0022751-00

• Unless otherwise agreed, invoices must be paid within seven (7) days.

• If an invoice remains unpaid after 30 days, a 5% late payment fee will be applied. This fee will continue to accrue every 30 days until full payment is received.

• If payment is not received, the Client is responsible for all collection costs, including solicitor or debt collection agency fees.

4. CURRENCY & GST

• All prices are in New Zealand Dollars (NZD) and exclude GST.

• GST applies to New Zealand residents but does not apply to overseas orders.

5. FEEDBACK & REVISIONS

• Clients are entitled to three (3) rounds of revisions for each project.

• Feedback and revisions must not:
  a) Change the fundamental nature of the deliverables.
  b) Be inconsistent with the original quote.
  c) Expand the project scope beyond the agreed work.

• Additional revisions outside the quoted scope will be charged at $80 + GST per hour.

• All revision requests must be made in writing via email.

6. ARTWORK APPROVAL

• Goldie Creative takes all reasonable precautions to ensure artwork accuracy. However, it is the Client’s responsibility to review and approve all artwork, including spelling, grammar, images, and colours.

• Changes cannot be accepted over the phone—corrections must be submitted via email.

• Once final approval is given, Goldie Creative is not responsible for any errors.

7. COPYRIGHT & INTELLECTUAL PROPERTY

• All designs on this website are the property of Goldie Creative and are protected by copyright. They may not be reproduced without written permission. Any copyright infringement will be prosecuted.

• The Client retains ownership of any materials (text, images, etc.) they provide for their project. It is assumed these materials are legally owned and free to use.

• Goldie Creative retains ownership of all design work until full payment is received. Once paid in full, ownership transfers to the Client.

8. RIGHT TO REFUSE SERVICE

Goldie Creative reserves the right to refuse any work that is:

• Unlawful, offensive, or inappropriate.

• Requested by a Client who does not accept legal responsibility for the content of their project.

9. PORTFOLIO USE

• Goldie Creative retains the right to use completed work for marketing purposes unless the Client provides written instructions to the contrary before project commencement.

• Unless a Non-Disclosure Agreement (NDA) is signed, Goldie Creative may showcase designs in portfolios, social media, and other promotional materials.

10. APPLICABLE LAW

• The Consumer Guarantees Act 1993 applies if the Client is purchasing services for personal or household use. If so, all rights under this Act apply in addition to those in this Agreement.

• If the Client engages Goldie Creative for business purposes, the Consumer Guarantees Act does not apply.

• This Agreement is governed by New Zealand law.

11. CHANGES TO TERMS

• We reserve the right to update these Terms at any time.

• If changes are significant, we will provide at least 30 days’ notice before they take effect.

• Continued use of our services after changes take effect constitutes acceptance of the new Terms.
